At Broadway Legal Limited trading as Broadway Law (‘We’, ‘Us’, ‘Our’), we take our privacy obligations seriously. We comply with the Privacy Act 2020 when dealing with personal information. Personal information is information about an identifiable individual (a natural person).

What personal information we collect

  1. Name, date of birth, address, IRD number and bank statements.

  2. Contact details, such as your email address, phone number, residential address and postal address.

  3. Identification information, such as your driver’s licence and/or passport.

  4. Biometric information, such as information about your fingerprints, voice, eyes, other biological or behavioural characteristics, or a photo/video of your face.

  5. Photos and/or image in any video footage.

  6. Employment and billing information.

  7. Medical documents or records.

  8. Financial information and/or evidence of source of wealth or funds.

  9. Computer/network Internet Protocol (‘IP’) address.

  10. Vehicle registration number.

  11. Any other information which will assist us in conducting our business, providing and marketing our services and meeting our legal obligations.

 

Who we collect your personal information from

We collect your personal information directly from you, where this is possible and practicable.

We may also collect your personal information:

  1. from our third-party contractor Realyou Limited (RealAML) to carry out customer due diligence as required under the Anti-Money Laundering and Countering Financing of Terrorism Act 2009. By law we are required to do this, and if we and/or our third-party agents are unable to obtain the requested information and/or documents from you, then we may not act for you.

  2. from someone else, where you have authorised this; 

  3. from publicly-available sources;

  4. automatically, when you visit our website or use our services, such as your IP address, web pages you viewed and links you clicked on. Some of this information is collected using cookies (text files saved on your device) and similar tracking technologies.

 

Why we collect your personal information

We collect your personal information for the following purposes:

​

  1. to conduct our business, deliver legal services to you and to communicate with you regarding the services;

  2. to verify your identity and undertake customer due diligence as required by the Anti-Money Laundering and Countering Financing of Terrorism Act 2009;

  3. to monitor suspicious or fraudulent activity;

  4. to bill you and collect money that you owe us;

  5. to protect and/or enforce our legitimate business interests and legal rights, including defending any claim and compliance with regulatory and audit functions;

  6. for any other purpose authorised by you or by the Privacy Act 2020.

 

Who we share your personal information with

There may be times where we need to share your personal information with third parties. We may use and disclose your personal information to:

  1. third parties who perform required checks for us that are necessary by law;

  2. Xero and Actionstep (or similar software) which provides the accounting and cloud-based legal practice management software to enable us to manage your file and invoice you;

  3. Our IT service provide which maintains our website and IT system;

  4. your mortgage advisor, Real Estate Agent and/or accountant, where they are assisting us and/or you in respect of sale and purchase of real estate or business;

  5. Data storage providers, consultants and/or barristers;

  6. regulators, law enforcement bodies, government agencies, dispute resolution providers, or other third parties where we consider it is necessary to comply with applicable laws or regulations, or to exercise or defend our legal rights. Where possible and appropriate, we will notify you of this type of disclosure;

  7. Other people, where authorised by you.

 

We may share your personal information with third parties based outside New Zealand. This means your personal information may be processed in an overseas country which does not provide the same level of protection to personal information as in New Zealand.

 

Security and storage

We will take reasonable technical and organisational precautions to prevent the loss, misuse or unauthorised alteration of your personal information. However, due to the nature of email, cybercrime and the internet, we cannot guarantee the privacy or confidentiality of your personal information. We may store your information in cloud or other types of networked or electronic storage.

If you wish to access or correct your personal information

Subject to certain grounds for refusal set out in the Privacy Act 2020, you have the right to ask for a copy of the personal information we hold about you, and to ask for your personal information to be corrected if you think it is wrong.

We may impose a charge for complying with your request for access to or correction of your personal information.
